Article 51 of the United Nations Charter, the right of Self-Defense and it’s limit in UN:

To Understand this all, First, let’s know what is United Nation? and whats it works?

The United Nation Organisation is an Organisation which was established in 1945 for maintaining  International Peace and  Security among the country. This Organisation has its own rules and regulations to run the organization. Here we will discuss Article 51 of the United Nations and the right of Self defense and its limitations etc.

What is Article 51 of the United Nation:

Article 51 of Unites Nation states that Every country has the right to Self Defense in any kind of war situation but Article 15 is quite limited in its authority, It allows the countries to use the Military force in action of Self Defense. If an armed attack occurs against a Member of the United Nations until the Security Council has taken measures necessary to maintain international peace and security. Measures taken by Members in the exercise of this right of self-defense shall be immediately reported to the Security Council and shall not in any way affect the authority and responsibility of the Security Council under the present Charter to take at any time such action as it deems necessary in order to maintain or restore international peace and security.

UN Article 51 right of Self-defence:

The right to self-defense enables states to use force lawfully to protect their sovereignty, political independence and security without any international responsibility. However, exercising this right is limited to one specific circumstance an armed attack. Moreover, states must demonstrate that force was used necessarily, proportionally and immediately, as well as informing the United Nations Security Council.

There is two rules of Self defense- Necessity and Immediately:

1. In order for a state to be entitled to the right of self-defense under customary international law, it must show the necessity of using force or the use of force must occur as soon as the threat arises and any force must be used in a proportionate manner.

2. As we mentioned, self-defence in international law. The customary understanding of self-defense is not only exercising a state’s right in response to a military attack but also to counter an imminent threat of armed attack. This type of self-defense is named anticipatory self-defense or pre-emptive self-defense.

Limits of right to Self Defense in UN article 51:

There is some limitation while using the forces of the nation as for the self-defense. These limitations are:

  • The uses of the nation’s forces must be in response to the Armed Attack.
  • The State will have to show the valid reason behind the self-defense attack.
  • The uses of force must be reported to the Security counsel by the state.
  • As soon as the Security Council takes the decision regarding the issue, the state will have to cease using force.

The main motto of this Organisation is to maintain peace and security among the countries and every country is compelled to follow the International Rules of the United Nations organization. This is very important for every country Citizen’s to live peacefully.
